These Terms & Conditions should be read together with our Privacy Policy, Cookie Policy, Delivery Policy and Refund & Returns Policy, where applicable.

Nothing in these Terms & Conditions affects your statutory rights as a consumer.

Terms of Website Use

3. Website Use

You may use our website for lawful purposes only.

You must not use our website:

  • in any way that breaches applicable UK or international law;
  • to commit or facilitate fraud;
  • to interfere with the operation or security of the website;
  • to introduce viruses, malware or other harmful material;
  • to attempt to gain unauthorised access to our website, systems or accounts;
  • to use automated systems, bots or scripts in a manner that interferes with the operation of the website or gives you an unfair advantage over other customers;
  • to place fraudulent, speculative or intentionally misleading orders; or
  • to abuse, harass or threaten our staff, contractors or other customers.

We reserve the right to restrict or suspend access to our website where we reasonably believe that these Terms & Conditions have been breached or where necessary to protect our website, business or customers.

4. Intellectual Property

Unless otherwise stated, all content appearing on this website, including text, graphics, logos, photographs, artwork, designs, page layouts, software and other materials, is owned by or licensed to Phantasm Forge or the relevant rights holder.

You may view and use website content for your own personal, non-commercial purposes.

You must not reproduce, copy, modify, distribute, sell, publish or commercially exploit our website content without our prior written permission.

Third-party trademarks, logos, character names and product names remain the property of their respective owners. Phantasm Forge does not claim ownership of third-party intellectual property.

5. Website Availability

We aim to keep our website available and operating correctly, but we cannot guarantee that it will always be available, uninterrupted or free from errors.

We may temporarily suspend, modify or discontinue parts of the website where reasonably necessary, including for maintenance, security, technical problems or circumstances outside our reasonable control.

We will make reasonable efforts to correct significant errors or problems affecting the website.

Orders and Purchases

6. Product Information

We make reasonable efforts to ensure that product descriptions, images, prices and availability information displayed on our website are accurate.

Product images are provided for illustrative purposes where appropriate. Packaging, artwork, promotional materials or other visual elements may occasionally differ from images displayed on our website.

Minor differences in colour or appearance may occur due to screen settings or manufacturer changes.

Where a product description contains a material error, we will take reasonable steps to correct it.

7. Product Availability

All products are subject to availability.

Displaying a product on our website does not guarantee that it will remain available.

For limited-release, allocated or highly sought-after products, manufacturers and distributors may provide retailers with quantities that differ from the quantities originally expected.

Where this affects an order, we will contact affected customers and explain the available options.

8. Placing an Order

When you place an order through our website, you are making a request to purchase the products in your order.

An automated order acknowledgement confirms that we have received your order. It does not necessarily mean that your order has been accepted.

A contract for the purchase of products will generally be formed when we send you an order confirmation confirming that your order has been accepted.

We reserve the right to refuse or cancel an order where there is a legitimate reason to do so, including:

  • suspected fraud or payment abuse;
  • significant pricing or listing errors;
  • stock or availability errors;
  • suspected resale, automated or abusive purchasing activity where restrictions apply;
  • failure to pass reasonable payment or security checks;
  • orders that breach applicable quantity restrictions; or
  • circumstances where we are unable to fulfil the order.

Where you have already paid for an order that we subsequently cancel, we will refund the amount paid using the original payment method unless otherwise agreed.

9. Pricing Errors

We take reasonable care when displaying prices.

If a product has been advertised at an obviously incorrect price due to a technical, typographical or system error, we reserve the right to correct the error and, where appropriate, cancel the affected order.

If an order is cancelled because of a pricing error after payment has been taken, you will receive a full refund.

We will not intentionally misrepresent the price of a product.

10. Quantity Restrictions

We may impose reasonable quantity limits on certain products, particularly limited-release, allocated or high-demand trading card products.

Any applicable quantity limit will be displayed on the product page or communicated to you.

Where we reasonably identify attempts to circumvent quantity limits through multiple accounts, orders, addresses or other methods, we may cancel affected orders and refund payments.

Quantity restrictions may be applied to individual customers, households, addresses or other appropriate purchasing groups where reasonably necessary.

Pre-Orders

11. Pre-Orders

Products advertised as Pre-Order are products that are expected to become available at a future release date.

The estimated release date displayed on our website is provided based on information available to us from manufacturers, distributors or suppliers.

Release dates can change and are outside our control.

If a manufacturer or distributor changes a release date, we will update customers where reasonably practicable.

12. Pre-Order Payment

Unless otherwise stated on the product page, payment for pre-orders may be taken when the order is placed.

By placing a pre-order, you acknowledge that the product may not be dispatched until its applicable release date.

If a pre-order is delayed, you may contact us regarding the order.

13. Orders Containing Pre-Orders and In-Stock Products

Where an order contains both pre-order and currently available products, we may hold the entire order until the pre-order product becomes available unless separate delivery has been specifically offered.

If separate delivery is available, any applicable additional delivery charges will be clearly communicated before they are incurred.

14. Manufacturer and Distributor Allocations

Some TCG products are subject to manufacturer or distributor allocation.

If we receive fewer units than expected, we may be unable to fulfil the full quantity originally ordered.

Where this occurs, we may reduce quantities or cancel affected orders.

If we reduce or cancel an order because we are unable to obtain sufficient stock, we will refund any amount paid for the affected products.

We will not charge customers for products that we cannot supply.

Payment and Security

15. Payment

Payment methods available at checkout will be displayed on our website.

Payment must be successfully authorised before an order can be processed.

We do not normally have access to your full payment-card details where payment is processed through a third-party payment provider.

We may carry out reasonable security and fraud-prevention checks before fulfilling an order.

16. Address and Order Verification

For certain orders, particularly high-value or unusual orders, we may carry out additional verification checks.

We may request reasonable information to verify an order or payment.

For security reasons, we may delay, cancel or refund an order where we reasonably believe that the payment, delivery details or transaction may be fraudulent or unauthorised.

We will not request your full payment-card number, PIN or online banking password by email.

Delivery

17. Delivery

We aim to dispatch orders within the timeframe stated on the website or in your order confirmation.

Estimated delivery times are not guaranteed unless expressly stated otherwise.

Once an order has been dispatched, delivery times are also dependent on the carrier.

You are responsible for providing an accurate delivery address.

18. Delayed Deliveries

If your order is delayed, please contact us so that we can investigate with the relevant delivery provider where appropriate.

Nothing in these Terms & Conditions limits your statutory rights where goods are not delivered within the legally applicable period or where a specific delivery time is essential under the circumstances.

19. Failed Delivery

If a delivery cannot be completed because an incorrect address was supplied, delivery was refused, or the customer failed to take reasonable steps to receive the parcel, we may charge reasonable additional delivery costs where permitted by law.

We will not charge unreasonable fees.

20. Lost or Damaged Deliveries

If your order appears to have been lost or arrives damaged, please contact us as soon as reasonably possible.

Where appropriate, we may ask for photographs or other information to assist with investigating a delivery or damage claim.

Your statutory rights remain unaffected.

Ownership and Risk

21. Risk

Risk in products passes to you when the products are physically delivered to you, or to a person nominated by you other than the carrier, where applicable.

This does not affect your statutory consumer rights.

22. Ownership

Products remain our property until we have received payment in full.

Returns, Cancellations and Refunds

23. Your Statutory Cancellation Rights

If you are a consumer purchasing goods online, you generally have the right to cancel your order within 14 days of receiving the goods, without giving a reason, subject to applicable legal exceptions.

You then generally have a further 14 days to return the goods after notifying us of your cancellation.

Nothing in these Terms & Conditions removes or reduces any cancellation rights you have under UK law.

24. Exercising Your Right to Cancel

To cancel an order, please contact us using the contact details displayed on our website.

You should provide:

  • your name;
  • order number;
  • the products you wish to cancel; and
  • a clear statement that you wish to cancel the contract.

You may use a standard cancellation form if provided, but this is not required.

25. Returning Products

Unless the goods are faulty, damaged, incorrectly supplied or another legal exception applies, you will generally be responsible for the direct cost of returning goods following cancellation under the statutory cooling-off period.

Products should be returned safely and appropriately packaged.

You may be responsible for any reduction in the value of goods resulting from handling beyond what is reasonably necessary to establish their nature, characteristics and functioning.

26. Sealed Trading Card Products

Many TCG products are sold as sealed collectible products.

Where a customer exercises a statutory cancellation right, applicable legal rights will apply.

Opening, damaging or materially altering sealed packaging may affect the value of a product and may result in a deduction for diminished value where permitted by law.

Nothing in this section affects your statutory rights concerning faulty, damaged, misdescribed or otherwise non-conforming goods.

27. Faulty, Damaged or Incorrect Products

If you receive a product that is faulty, damaged, materially different from its description or the wrong product, please contact us.

We will assess the issue and provide an appropriate remedy in accordance with applicable UK consumer law.

Depending on the circumstances, this may include repair, replacement, refund or another remedy required by law.

We will not ask you to pay return costs where the product is being returned because it is faulty, damaged, incorrectly supplied or otherwise does not conform to the contract, where the law requires us to cover those costs.

28. Refunds

Where you are entitled to a refund, we will process it within the timeframe required by applicable law.

Unless otherwise agreed or required by law, refunds will normally be made using the original payment method.

Where you exercise a statutory cancellation right, we will generally refund the standard delivery cost originally paid, but we may not be required to refund additional costs resulting from your choice of a more expensive delivery option.

TCG-Specific Terms

29. Trading Card Product Condition

Unless explicitly stated otherwise, products listed as new or sealed are intended to be supplied in the condition received from the manufacturer or distributor.

Minor imperfections to outer packaging, including small dents, scuffs, shrink-wrap irregularities or similar cosmetic issues, may occur during manufacturing or transportation.

Such cosmetic imperfections do not necessarily mean that the underlying product is faulty.

Where a product has suffered significant damage before delivery, please contact us so that we can assess the matter.

30. Manufacturer Errors

We are not the manufacturer of the TCG products we sell.

Where a product contains a manufacturing error, missing component, printing defect or other manufacturer-specific issue, we will assist customers where reasonably practicable.

Where the appropriate remedy is provided by the manufacturer or publisher, we may direct customers to the relevant manufacturer support service.

This does not remove or limit any statutory rights you have against us.

31. Promotional Items and Bonuses

Where a product includes a promotional item, bonus, pack, card or other additional item, this will be subject to the terms stated on the relevant product listing.

Promotional items may be subject to availability where this is clearly stated.

If a manufacturer changes or withdraws a promotion before fulfilment, we will provide appropriate information to affected customers where reasonably practicable.

Accounts

32. Customer Accounts

Where you create an account, you are responsible for keeping your login information secure.

You must provide accurate information and keep your account details up to date.

You must not knowingly allow another person to use your account in a way that breaches these Terms & Conditions.

We may suspend or close an account where we reasonably believe it has been used fraudulently, unlawfully or in breach of these Terms & Conditions.

Closing or suspending an account will not remove any statutory rights you have.

Third-Party Websites

33. External Links

Our website may contain links to third-party websites.

These websites are not controlled by Phantasm Forge and we are not responsible for their content, security, availability or privacy practices.

Following an external link is at your own discretion.

Limitation of Liability

34. Liability

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful.

This includes liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation;
  • breach of statutory consumer rights; or
  • any other liability that cannot legally be excluded or limited.

Subject to the above, we will not be responsible for losses that were not reasonably foreseeable at the time the contract was formed.

If you are purchasing products wholly or mainly for business purposes, additional limitations may apply to the extent permitted by law.

Nothing in these Terms & Conditions affects your statutory consumer rights.

Events Outside our Control

35. Force Majeure

We will not be responsible for delays or failures caused by circumstances reasonably beyond our control.

These may include, for example:

  • manufacturer or distributor delays;
  • product release-date changes;
  • supplier shortages;
  • postal or courier disruption;
  • strikes;
  • severe weather;
  • natural disasters;
  • power or internet outages;
  • cyberattacks;
  • government action; or
  • other events that could not reasonably have been prevented.

Where such an event affects your order, we will take reasonable steps to minimise the impact and keep you informed where appropriate.

Nothing in this section limits your statutory cancellation or consumer rights.

Privacy

36. Privacy

We process personal information in accordance with our Privacy Policy and applicable UK data-protection legislation.

Our Privacy Policy explains what information we collect, why we collect it, how we use it and your rights in relation to your personal information.

General

37. Changes to These Terms

We may update these Terms & Conditions from time to time.

The version applicable to your purchase will generally be the version in force when your order is accepted, unless a change is required by law or otherwise applies to an existing contract.

The latest version will be published on our website.

38. Severability

If any provision of these Terms & Conditions is found to be invalid, unlawful or unenforceable, that provision will be modified or removed only to the extent necessary.

The remaining provisions will continue to apply.

39. No Waiver

If we do not immediately enforce a right under these Terms & Conditions, this does not mean that we have waived that right.

40. Entire Agreement

These Terms & Conditions, together with any policies expressly incorporated into them, constitute the terms governing your use of our website and purchases made through it.

41. Third-Party Rights

Unless otherwise required by law, a person who is not a party to a contract between you and Phantasm Forge will not have rights to enforce its terms under the Contracts (Rights of Third Parties) Act 1999.

42. Governing Law

These Terms & Conditions and any contract between you and Phantasm Forge are governed by the laws of England and Wales.

If you are a consumer living in Scotland or Northern Ireland, you may also have rights to bring proceedings in the courts of the relevant jurisdiction where applicable.
